These Terms & Conditions (the “Terms”) govern your access to and use of the Warshah software and related services (the “Service”), provided by Dev Lakes (“we”, “us”, “our”). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Warshah is cloud-based software (software-as-a-service) that helps auto bodyshops manage the vehicle repair lifecycle, including reception, estimation, insurance claims, parts procurement, production, quality control and delivery. The Service is software only. We do not sell physical products, require physical delivery, or provide consulting, advisory, or professional repair services.

2. Accounts & eligibility

The Service is intended for business use. You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account and the accounts of users you invite.

3. Subscriptions, billing & payment

The Service is offered on a subscription basis. Current plans and prices are shown on our pricing page and are billed monthly or annually depending on the plan you select. Payments are collected at checkout by Paddle (Paddle.com Market Ltd), which acts as our authorised reseller and the Merchant of Record for your subscription and is responsible for processing payment and charging any applicable taxes.

Subscriptions renew automatically for successive billing periods until cancelled. We may change our prices; where we do, we will give reasonable notice and changes will take effect at your next renewal.

4. Cancellation & termination

You may cancel your subscription at any time. Your access continues until the end of the billing period you have already paid for, after which it will not renew. Refunds, where available, are governed by our Refund Policy. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • copy, resell, sublicense, or make the Service available to third parties except as expressly permitted;
  • reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems; or
  • upload unlawful, infringing, or malicious content, or content you do not have the right to use.

6. Your data

You retain ownership of the data you and your users enter into the Service (including your customers’ and vehicles’ records). You grant us a limited licence to host, process and transmit that data solely to provide and support the Service. Our handling of personal data is described in our Privacy Policy. You are responsible for ensuring you have the right to provide any personal data you enter, including that of your own customers.

7. Intellectual property

We and our licensors own all rights, title and interest in the Service and its software, including all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for the duration of your subscription.

8. Availability & support

We use commercially reasonable efforts to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance and may modify or discontinue features from time to time.

9. Disclaimers

Except as expressly stated and to the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, or consequential damages, or loss of profits or data. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Jordan, and the courts of Jordan will have jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you.
